RE: CASE OF AN ALLEGED CASE OF INCITEMENT RIOTOUS CONDUCT AND DISORDERLY BEHAVIOUR AGAINST MOHAMED KABBA.
INTRODUCTION:
This official notice is issued pursuant to the powers vested in the Sierra Leone Police under the Treason and State Offences Act, 1963; the Criminal Procedure Act, 1965; the Public Order Act, 1965 and all other enabling laws of Sierra Leone. You Mohamed Kabba were alleged to have orchestrated and committed serious criminal offenses, namely, Incitement, riotous conduct and Disorderly Behaviour.
According to investigations, this has to do with a case of Riotous Conduct and disorderly behaviour by some rioters who were involved in planning and participating in various demonstrations across the country, especially the August 10, 2022 demonstrations in the country. Conduct likely to cause the breach of the peace. This case is incidental for investigation.
BRIEF FACTS: The Sierra Leone Police are actively investigating the role of Mohamed
Kabba orchestrated other individuals affiliated with the main opposition party in organizing and participating In the demonstration
(SLPP) on the 10th August’ 2022. These actions are alleged to have contravened the laws of Sierra Leone, specifically: Treason and State Offences Act, Section 3(1) Charges of destabilization to the government- The Public Order Act, 1965 Section 12, 16 and 17: Prohibits riotous and disorderly conduct, incitement to violence, and participation in unlawful assemblies with intent to destabilize the state.
Investigations revealed that Mohamed Kabba was alleged to have orchestrated and organized and mobilized individuals to burn down Calaba town police station in the east end of capital city of Freetown and left many civilians dead including six police officers who were brutally killed by angry youths. Mohamed Kabba has been declared wanted by the Law Enforcement Institution the Sierra Leone Police for a case of Incitement, riotous conduct and disorderly behaviour on the August 10th 2022 demonstration.
According to the Public Affairs Department of the Sierra Leone Police through a press release signed by the Inspector General of Police, that Mohamed Kabba was fully involved in the August 10th 2022 demonstrations in the east end of Freetown, one of the populated area in the capital city of Freetown, when protesters took to the streets in protest for the increase in the pump price of petroleum product and for the economic hardship in Sierra Leone on the 10th August, 2022, making roadblocks and burning of tires on the highway that runs through several communities in the east end of Freetown.
Some youths were arrested and charged to court and many of them are now undergoing trials whist others escaped to an unknown destination. Police personnel stormed the residence of Mohamed Kabba to effect his arrest on that faithful day but he and his family members is nowhere to be seen. During the investigations, it was revealed that Mohamed Kabba was the actual man who incites other youths to burn the Calaba town police station during the demonstration.
As a result, he has been declared a fugitive by the police and a warrant of arrest was issued for his immediate apprehension and a handsome reward was offered to whosoever provides useful information that would lead to his arrest. By the authority vested in the Sierra Leone Police under the Criminal Procedure Act, 1965 section 27 it’s the responsibility of the force to execute the warrant of arrest against you are hereby ordered to present himself immediately at the nearest police station or the Criminal Investigations Department (CID) Headquarters, Pademba Road, in further legal action, including but not limited to, prosecution in absentia and the full enforcement of all applicable penalties under Sierra Leonean law.
It is an offense according to Section 4 (12) Cap 2 in the Criminal Procedure Act of 1965 of Sierra Leone that any person who involved in divulging secrete information illegally to destabilize the country will be prosecuted to life imprisonment.
Meanwhile; a warrant of arrest for Mohamed Kabba has been put in force by the Police whilst he has gone into hiding and his whereabouts is still unknown. His photos have been displayed at the Criminal Investigations Department (CID) Headquarters in Freetown and the Police are encouraging the general public to give any vital information that will lead to his arrest. These led him being declared a wanted fugitive.
